IS A NANNY ENTITLED TO SMP?
Yes they are as long as they have been in the same employment for 26 weeks prior to the notification week which is 15 weeks before the baby is due.
The first 6 weeks of your maternity leave you will receive 90% of your salary, and for the further 33 weeks you will receive SMP (from April 2019 £146.68 per week).
Maternity pay is usually 100% claimable back and you will need to give your employers your MAT B1 form (you usually get this around 20weeks from your midwife) for them to claim the money back.
Annual leave is accrued whilst on maternity leave as normal and is at the employer’s expense. You will not accrue annual leave if you are made redundant or resign as you go on maternity leave.
You are entitled to paid time off for appointments advised by your Dr or Midwife. The employer can make reasonable contact with you whilst on maternity leave to discuss your return to work.
Employers must hold your position open in the same capacity in which you went on maternity leave and they do not have to allow you to return to work with your baby.
